The job
Crops: Corn, Lettuce
Harvesting Iceberg Wrap Lettuce: The lettuce cutters will line up in designated lettuce rows. Workers will bend over each lettuce to cut. After cutting the lettuce. Workers will inspect and trim. Workers will then put the lettuce in a bag and put the bag on a stainless-steel table that will be continually pushed behind the cutters as they proceed on their rows.
Romaine Lettuce: The cutters (crew of 12) will be taken to designated fields that are ready for harvest, the cutters will line up in front of the harvest machine, the machine has a conveyor belt that goes around the machine bringing in empty boxes, the cutter will bend over, cut and trim the romaine lettuce, put it inside the box or RPC, each container should have 4 lines of 6 romaine lettuce each, they will close the box and put the box on the conveyor belt to be transported to the back of the machine. On the romaine machine there is a platform where closers, stockers, strap and pallet jack person work, the crew consist of 10-14 workers. The workers should always keep in mind that they must meet TKM Bengard Farms, LLC quality standards, meeting these standards is a very important part of the job. Cutters will have 5 days to train for this quality standards and quantity of work expected from them. In order to be able to keep up with the machine, workers should be able to cleanly cut: 12-13 heads per minute of iceberg wrap lettuce heads, 16-18 heads per minute of Romaine flip top, 16-18 heads per minute of Romaine Hearts, 16-20 heads per minute of any naked commodity. The workers in order to perform this kind of work must be able to work outside for at least 6 hours a day in all kinds of weather and be in possession of the requisite physical strength and endurance to repeat the cutting process rapidly, the employer will provide the tools necessary to perform the described job duties without charge to the workers. The employer will charge the worker for reasonable costs related to the worker's refusal or negligence to return the tools or due to such worker's willful damage or destruction of the tools.
Corn: A corn puller will first be taken to designated field ready to be cut and harvested for the day. Once the corn puller is properly ready for work, the corn puller will line up in corn rows designated for him to pull. The worker will then proceed to stand in his or her area and bend over to each stalk and snap off ears of corn that are available to pull with his hands. After snapping off ears of corn, he will inspect them and then throw them onto tables that are located on the corn harvesting machine that will be moving behind the corn pullers as they continue to move forward in their designated rows. Everyday there will be different corn orders, there will be days when it will contain certain specifications on what needs to be cut, for example when dealing with first and secondary ear of corn etc. Depending on what the corn stalks have on them. The workers will be pulling corn, always keeping in mind that he will always have to meet company quality standards. Meeting these standards is a very important part of the job and the corn puller will have three to four days to train for these quality standards and the quantity of work expected from them and any other coworker doing the same job. Meals: Employer-provided housing includes free and convenient kitchen facilities with appropriate equipment, appliances, cooking accessories, and dishwashing facilities for meal preparation. Workers residing in employer-provided housing will be provided free transportation once per week to/from closest town or city for personal errands (e.g., groceries, banking services). Dining, kitchen/cooking facilities and other common areas are shared by all workers. In the event that kitchen facilities become unavailable during the contract period, employer will provide three daily meals in accordance with 20 CFR 655.122(g). In such circumstances, employer will deduct the cost of such meals up to the maximum allowable amount published in the Federal Register, or as otherwise approved by the U.S. Department of Labor.
Transport: Employer will permit workers to select any means of transportation they choose and reimburse workers at no less than the most economical and reasonable common carrier (e.g., van, bus, plane) transportation charges for the distances involved for both inbound and outbound transportation. Inbound transportation provided from the foreign worker's home city to the U.S. consulate and from the U.S. Consulate to the work site.

Worker must possess the physical strength and endurance (ability to continue or last) to repeat the harvest process though out the workday, working quickly and skillfully to perform activities assigned during that activity. Workers must work at a sustained (continuing for an extended period of time without interruption), vigorous pace (quick and steady) and make bona fide efforts (made in earnest intent) to work efficiently (performing or functions in the best possible manner with the least waste of time and effort) and consistently (same way for a long time) that are reasonable under the climatic and other working conditions, Workers may not leave trash, or other discarded items in work areas or vehicles but must dispose of such items in provided receptacles. Workers must wash hands with soap and water after all bathroom and meal breaks.
