The job

Workers will perform assigned duties as described in this clearance order,

Planting of vegetables: A tractor will go over the fields making holes for the plants, workers will grab a tray of plants from the truck, walking down the rows the worker will put one plants per hole, when finish with the tray, the worker will walk back to the truck and grab another tray of plants, repeating the process through the work day.

Harvesting of vegetables: Once at the picking location, doing a row at a time, workers will move down the rows plucking the vegetables from the plants and putting them in a bucket/bushel. Once the bucket/bushel is full the worker will take the bucket/bushel to the truck and dump the bucket/bushel. The worker will go back to his picking area and fill his bucket/bushel up again, repeating the process through the work day.

Note: Harvesting Compensation Includes Taking boxes to the field, making boxes, adding paper and lining up boxes on the rows so they can be staked onto the pallets.

Field Maintenance: workers will tie, stake and prune plants, clean micro jets and remove plastic drip lines, using hands or a hoe, workers will remove dead plants and weeds.

General Farm Maintenance and Other Activities: When primary planting or harvesting work is temporarily unavailable due to weather conditions, crop conditions, operational needs, or other lawful business reasons, workers may be assigned miscellaneous incidental duties directly related to the agricultural operation. These duties will not replace or substantially reduce the availability of primary agricultural work. Such duties may include general clean-up of the worksite, farm property, and agricultural structures; weeding, trimming, digging, cutting, topping, and removal of weeds, vines, debris, and trash from fields and fence lines; routine installation and removal of plastic mulch and irrigation drip tape; and basic irrigation maintenance and minor repair. Field sanitation activities may include cleaning, disinfecting, maintaining, and performing minor upkeep to harvest buckets, bins, trailers, hand tools, and similar agricultural equipment. Workers may also assist with the routine cleaning, washing, and minor non-mechanical upkeep of farm vehicles and equipment. Workers may be required to assist with the basic cleaning and routine upkeep of employer-provided housing and common-use facilities, limited to minor, basic tasks necessary to maintain safe, sanitary, and healthy living conditions.

Workers must be able to perform strenuous manual labor outdoors for extended periods in varying weather conditions, including heat, cold, humidity, wind, and rain, for the total hours offered in the work contract. Duties require physical strength and stamina to walk, bend, stoop, kneel, lift, carry, reach, and stand for prolonged periods. Workers must be able to perform repetitive hand and arm movements throughout the workday while maintaining a continuous workflow. The employer will provide, at no cost to the worker, all tools, supplies, equipment, and personal protective equipment required to perform the assigned duties. Consistent with applicable law, the employer may recover the reasonable cost of repairing or replacing tools or equipment damaged through a worker’s willful misconduct or gross negligence, provided any such deduction is authorized in writing by the worker after the damage occurs and does not reduce the AEWR or any applicable minimum wage requirement. At the employer’s sole discretion, workers may receive bonus compensation or pay above the offered wage rate based on factors such as tenure, attendance, or overall work quality, provided such payments apply consistently and do not modify the baseline terms and conditions of employment stated in this clearance order.

Housing: Employer-provided (including mobile or range)

Meals: Employer-provided housing includes free and convenient kitchen facilities with appropriate equipment, appliances, cooking accessories, and dishwashing facilities for meal preparation. Also will provide transportation once per week to go to the stores and do laundry.

Transport: For workers hired from beyond normal commuting distance, after completion of 50 percent of the work contract period, the employer shall reimburse the worker for cost incurred by the worker for transportation and daily subsistence, as required by DOL regulations, from the place from which the worker has come to work for the employer to the place of employment.

This type of work, involves working conditions that require tremendous stamina, a high level of physical activity in cold or extremely hot conditions in direct sunlight and in adverse weather such as rain. The work requires a high level of physical conditioning. Due to the type of work involved, there is a Probationary Period of five (5) days beginning with the first day of employment, to show possession of the requisite physical strength and endurance to perform this type of work.
